CONDITIONS OF ENTRY & SALE
Online Timed Sale of Working Sheepdogs
ENTRIES & SALE ARRANGEMENTS
1. Entry Fees
Entry fee for all entries is £20 + VAT per dog and all entries must be submitted with the entry fee either via the online link, BACS or cheque. An entry will not be considered complete until the relevant fee has been received. The entry fee is non-refundable.
2. Sale Date
All dogs entered will be offered for sale via timed online auction, with bidding ending on Sunday 18th October 2026.
3. Order of Sale
The order of sale will be in lot number order following a ballot.
VIDEOS & ONLINE BIDDING
4. Vendor Videos
Videos must be received by Ruthin Farmers Auction no later than 10 days before the sale. Videos may be supplied by:
· YouTube link; - uploading/sending a video with the entry form; or WhatsApp to 07867 977706.
The Auctioneers give no warranty as to the dog’s future ability or that it will work to the same standard for its new owner.
5. Buyer’s Premium
A buyer’s premium of 4% + VAT will apply. This includes the internet hosting fee.
6. Vendor Commission
Vendor commission will be charged at 1% + VAT of the final price.
7. Withdrawal or Cancellation of Lots
Ruthin Farmers Auction reserves the right to withdraw, remove or cancel any lot or sale at any time before, during or following the sale where considered necessary.
8. Failure to Complete a Transaction
The purchaser shall have no claim against Ruthin Farmers Auction where a lot cannot be delivered. Should a purchaser default, Ruthin Farmers Auction will make reasonable endeavours to contact an underbidder but accepts no responsibility for any resulting shortfall, loss or liability arising from the cancellation of the original transaction. Formal payment demands may be issued to any purchaser who has failed to pay for a lot within 48 hours of the close of the sale.
9. Payment & Settlement
Settlement is due at the close of bidding. Successful purchasers will be invoiced following the sale; for evening sales, invoices may be issued the following morning. All payments must be made in pounds sterling (£) and paid in full, including any applicable buyer’s premium and VAT.
10. New Online Bidders
Customers who have not previously purchased through Ruthin Farmers Auction and intend to bid online should contact the office at least 24 hours before bidding opens. This allows customer details to be verified and an appropriate credit limit to be established.
VENDOR DECLARATIONS & WARRANTIES
11. Working Ability
Dogs are offered for sale using videos supplied by the vendor. No warranty is given or implied that a dog will perform to the same standard for a new owner. In respect of working ability, all dogs are sold on a non-returnable basis.
12. Health Information
Any warranty or declaration made by the vendor concerning eye tests, health tests or other health-related matters must be supported by appropriate independent documentation where applicable.
13. Bitches in Pup
Bitches must be clear of pup unless specifically stated otherwise in the catalogue. Any purchaser making a complaint must provide a veterinary certificate confirming that the bitch was in whelp at the time of sale. Vendors are responsible for ensuring that a bitch remains empty during the period between the sale and collection.
14. Unsoundness
Unless otherwise declared in the catalogue, all dogs are warranted by the vendor to be free from unsoundness. Any complaint must be made within 5 days of delivery and supported by a veterinary surgeon’s certificate confirming that the condition or defect existed at the time of sale. This includes physical defects, breeding defects, castrated dogs, dogs with one testicle and spayed bitches. Any dog/bitch of a “nervous” nature showing signs of anxiety or timid behaviour following delivery to the buyer will not be warranted and will not be considered unsound for the purpose of return or refund. Where a valid claim is established in accordance with these conditions, the purchaser will be entitled to reimbursement together with reasonable associated costs and expenses. For any complaint to be valid, the dog must have been collected within the specified collection period.
15. Disputes
Where a dispute arises concerning an alleged breach of warranty, the matter will be referred to the Auctioneer or another suitably qualified person appointed by the Auctioneer. The appointed referee may examine or trial the animal and make such enquiries of the parties as are considered necessary. The resulting decision shall be final.
16. Commands & Whistles
Vendors must state the language used for voice commands and must provide relevant information regarding whistle commands where applicable.
EXPORT & VAT
17. Export-Ready Dogs
Any dog described as “Export Ready” must be vaccinated, identified and documented in accordance with the relevant requirements for export to the EU and Northern Ireland. Any additional export requirements, veterinary certificates or health documentation beyond these requirements will be at the purchaser’s expense. This includes any requirements for dogs being exported outside the EU and Northern Ireland.
18. VAT
Vendors must declare whether they are VAT registered. UK purchasers will be liable for VAT where applicable. Purchasers outside the UK may be eligible for zero-rating where the appropriate criteria are satisfied. VAT-registered vendors offering dogs from outside the UK must comply with the requirements of their country of export and are responsible for familiarising themselves with the relevant regulations.
COLLECTION & POST-SALE ARRANGEMENTS
19. Collection
Collection and onward transport of the dog is the responsibility of the purchaser. Where a purchaser uses a courier collecting from a central collection point situated within 30 miles of the vendor’s home address, the cost of transporting the dog to that collection point will be borne by the vendor.
20. Delayed Collection
Where collection is delayed beyond 35 days, the purchaser will be liable for a kennelling charge of £30 per week. Both vendor and purchaser should ensure that any carrier used is appropriately insured and compliant with relevant requirements.
21. Insurance
The dog will remain insured by the vendor while it remains in the vendor’s custody and until collection has taken place.
22. Documentation
All documentation relating to the dog must be handed to the purchaser or authorised carrier at the time of collection.
23. Microchips
The dog’s microchip should be scanned and its identity verified at the time of collection. Microchip numbers scanned in the dog/dogs must correspond with the microchip number on the ISDS card and/or vaccination cards.
24. Vendor Payment
Vendors must notify Ruthin Farmers Auction once the dog has been collected. Payment to the vendor will normally be made 7 working days following confirmed collection. Ruthin Farmers Auction reserves the right to withhold payment where a dispute has arisen until that dispute has been considered and resolved in accordance with these Conditions of Sale.
25. Export/Import Due Diligence
Purchasers are responsible for completing all necessary export and import checks before bidding. Any costs or requirements not specifically covered within these Conditions of Sale remain the responsibility of the purchaser.
VIDEO REQUIREMENTS
26. Video Format
Vendors are encouraged to keep videos clear, concise and representative of the dog being offered. As a minimum, the principal video should:
· be recorded in landscape format, with the phone held on its side and as one continuous video
· clearly show the dog’s microchip being scanned; and show the dog working at reasonably close range.
Vendors may provide up to two additional videos to demonstrate the dog’s working ability or technical capabilities. Vendors are responsible for ensuring that any music or third-party material used within their videos complies with applicable copyright requirements.
27. Puppies
This sale does not accept puppies. All dogs/bitches must be over 6 months old.
28. Copyright
Copyright in all videos supplied remains with the vendor. By submitting a video for the sale, the vendor permits Ruthin Farmers Auction to use and display the video for the purposes of advertising, cataloguing and conducting the sale.
IMPORTANT
It is your own responsibility to take the necessary precautions when viewing a dog, collecting a dog or recording a video for the purpose of the sale.
The sale is held subject to the Auctioneers’ Conditions of Sale as recommended for use by the Livestock Auctioneers Association Ltd, as revised January 2022.
